These Terms of Service (“Terms”) govern your use of the Cooltivo mobile application and website (the “Service”) provided by Cooltivo Inc. (“Cooltivo,” “we,” “us,” or “our”). By using the Service, you agree to these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, do not use the Service.

2. Description of Service

Cooltivo is a fitness tracking platform that helps users log workouts, follow training programs, and interact with AI-powered coaching characters (“Habitants”). The Service includes:

• Workout logging and exercise tracking
• AI-generated workout programs and exercise recommendations
• Conversational AI coaching through Habitant characters
• Fitness progress analytics

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information during registration.

4. AI-Generated Content

The Service uses artificial intelligence to generate workout programs, exercise recommendations, and conversational responses. Please understand that:

• AI-generated content is created by automated systems, not human professionals
• AI responses may contain inaccuracies or errors and should not be relied upon as professional advice

5. Health & Fitness Disclaimer

The Service provides general fitness information only. Cooltivo is not a medical provider, and the Service does not constitute medical advice. You should consult a qualified healthcare provider before starting any exercise program. By using the Service, you acknowledge and accept the inherent risks of physical exercise. 6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to circumvent security features or access other users’ data
• Submit harmful, abusive, or inappropriate content through chat features
• Attempt to extract or reverse-engineer AI model prompts or training data
• Use the Service to generate content that could cause harm to others
• Resell, redistribute, or sublicense the Service

7. Your Content & Data

You retain ownership of the content you create through the Service (workout logs, profile data, chat messages). By using the Service, you grant Cooltivo a license to store, process, and transmit your content as necessary to operate the Service.

8. Account Deletion

You may delete your account at any time through the app settings. Deleting your account will permanently remove all associated data, including your profile, workouts, programs, chat history, and fitness data. This action cannot be undone.

9. Limitation of Liability

To the maximum extent permitted by law, Cooltivo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. This includes, without limitation, any personal injury resulting from exercise activities performed based on content provided by the Service.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will be accurate, complete, or suitable for your specific needs.

11. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms in the app. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

12. Termination

We may suspend or terminate your account if you violate these Terms or engage in conduct that we determine, in our sole discretion, is harmful to the Service or other users.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of competent jurisdiction.
